<br />I <br /> <br />I <br /> <br />. <br /> <br />and conditions of refunding bonds shall be substantially the <br />same as those of an original issue of bonds; <br />(h) To have the management, control, and supervision of all the <br />business and affairs of the district, and the construction, <br />installation, operation and maintenance of district improve- <br />ments therein; <br />(i) To hire and retain agents, employees, engineers, and attorneys; <br />(j) To have and exercise the power of eminent domain and dominant <br />eminent domain and, in the manner provided by law for the con- <br />demnation of private property for public use, to take any prop- <br />erty necessary to the exercise of the powers granted, both with- <br />in and without the district; <br />(k) To construct and maintain works and establish and maintain fa- <br />cilities across or along any public street or highway, and in, <br />upon, or over any vacant public lands, which public lands are <br />the property of the state of Colorado, and to construct works <br />and establish and maintain facilities across any stream of water <br />or watercourse, and to enter into contract with public utilities, <br />cooperative electric associations, and municipalities for the <br />purpose of furnishing.street lighting service. The district <br />shall promptly restore any such street or highway to its former <br />state of usefulness as nearly as may be and shall not use the <br />same in such manner as to completely or unnecessarily impair the <br />usefulness thereof; <br />(1) In any safety protection district, to erect and maintain traffic <br />and safety controls and devices on streets and highways and at <br />railroad crossings; to enter into agreements with the county or <br />counties in which a district is situate, or with adjoining <br />counties or the state department of highways or with railroad <br />companies for the erection of such safety controls and devices, <br />and for the construction of underpasses or overpasses at rail- <br />road crossings; <br />(m) To fix and from time to time decrease or increase the rates, <br />tolls, or charges for services or facilities furnished by the <br />district; <br />(n) To adopt and amend bylaws not in conflict with the constitution <br />and laws of the state for carrying on the business, objects, <br />and affairs of the board and of the district; <br />(0) To pass and enforce regulations promulgated by the board to <br />effectuate the purposes for which the district was organized. <br />Notice of the intent of the board to adopt rules and regulations <br />must be published at least twenty days prior to the date of the <br />public hearing on the adoption of such regulations. Regulations <br />adopted by the board shall become effective ten days after <br />public hearing is had thereon. <br />(p) To have and exercise all rights and powers necessary or inci- <br />dental to or implied from the specific powers granted in this <br />article.
