In the event of an <br />insufficient supply, AGUA will equitably allocate the available water. <br /> <br />Primary Augmentation Plan <br /> <br />Replacement water owned or leased by AGUA will be made available under the Primary or Supplemental Plans. Plan Participants <br />will be charged based upon water costs and number of wells within the plan. Replacement water will be delivered by AGUA at the <br />direction of tile Division Engineer, and in accordance with the Division 2 Rules, to replace depletions to senior Colorado water <br />rights and usable state line flows. <br /> <br />Plan participants shall be required to submit tbe amount of well pumping in acre feet that thcy want to have augmented not <br />later than January 15, 1997 and every year after. Plan participants shall also be reqnired to submit a form to AGUA for the <br />Southeastern Colorado Conservancy District and the Reclamation Reform Act for persons who own or operate 240 acres or more of <br />irrigable land This forn1 is considered as part of our application process. <br /> <br />Any well or group of wells requiring a substitute supply plan will bear any additional engineering costs. <br /> <br />Supplemental Augmentation Plan <br /> <br />Any well users not submitting a completed application with sufficient fees by the deadlines OR any well user applying after <br />February 15tb can only be augmented through the supplemental plan. This plan would be implemented with an amendment to <br />our primary plan and if the Association is able to find additional augmentation water, Wells in the supplemental plan will be <br />assessed an additional $200 per well to amend tile Primary Plan or, with board approval, sharing the eosts of the amendment with <br />those persons amending the plan, whichever is the lesser of the two. <br /> <br />Rules and Regulations <br /> <br />The Division 2 Rules require that all groundwater diversions be augmented based on prescribed depletion rates. If the Plan does <br />not meet the participants' full augmentation requirements, participants will be held responsible for adhering to the Rules and <br />curtailing groundwater diversions as necessary if you reach your purchased or reserved amount of water. The Rules will be strictIy <br />enforced. You may request to purchase more water if there is water available or you may choose to sell back a portion of your <br />reserved amount to persons diverting from the same geogrnphicaI area as prescribed by the Division Engineer. <br /> <br />In the event individual participants underestimate their annual grow1dwater diversions, and AGUA projects that their <br />depletion's will exceed their replacement water allocation, the Division Engineer shall notify the well participants and <br />AGUA until more water is found for that well, <br /> <br />The total augmentation water required for replacement of groundwater diversions for irrigation will be based on actual monthly <br />groundwater diversions as supplied by the participants in the Plan or the electric companies, and the replacement rates required by <br />the presumptive depletion's established in the Division 2 Rules. The present presumptive replacement factors established in the <br />Division 2 Rules for irrigation groundwater diversions under this plan are as follows: <br /> <br />30% oftotal acre-feet pumped (diverted) for supplemental irrigation supply (those persons that use their <br />well/wells as a supplement to their ditch water rights). <br />50% of total acre-feet pumped (diverted) for sole source irrigation supply (those persons that don't use any ditch <br />water rights and rely totally on their well/wells. <br />75% of total acre-feet pumped (diverted) for sprinkler irrigation supply (those persons that use their wells strictly <br />for sprinkler irrigation, whether supplemental or sole source) <br /> <br />A complete set of Rules and Regulations are available from the Division 2 Engineer's Office. <br /> <br />Form 13 - Groundwater Use Information Form <br /> <br />This form must be submitted for each well in order to be in compliance with Rule 13 of the amended Rules and <br />Regulations. This fonn is provided by the Division 2 Engineer's Office and must only be completed one time, except in <br />cases of changes of ownership or other changes in the use of the well.
