Thc association is operalcd by a board elcctcd by thc <br />membership. Its goals arc to provide augmentation water and to purchase water rights to cnable its membership to continuc to <br />benefit from tile use of thcir wclls. The association board meetings are open to thc membership and mcmbers are cncouraged to <br />participate. Each board meeting is held on the second Wedncsday of evcry month at 12:00 noon in Manzanola at the Ranchers <br />Rcstauranl. Bc sure to call before you come because of uncxpectcd canccllations. <br /> <br />Participants undcr the AGUA Plan will be required to comply witil the State Engineer's Rules and Rcgulations Govcrning the <br />Measurcment of Tributary GroUlldwater Diversions located in the Arkansas River Basin, Colorado. by providing a tested power <br />consUlllption co-efficient or flow meter verification to AGUA Plan admiuistrators, and signing a statement ofrelease of power <br />records (Fonn 13). The Division Engincers Office will collcct and compile power records on a monthly basis, and provide <br />groundwater diversion records to AGUA. <br /> <br />For wells on alternative power sources not provided by a Utility Company, (flow mcters, slave meters and the associatcd main <br />meters) water diversions must be measured and readings submitted to AGUA Plan adtuinistrators on a montilly basis wititin fivc <br />days following the end of tile montil. These records will tilen be provided to the Division Enginecr. <br /> <br />Failure of participants to submit rccords in a timely mamler will result in tcrmination of their participation in the Plan, loss of fee <br />assessment, and notification of their non-<:ompliance to the Division Engineer for appropriate action. <br /> <br />1997 Fees and Administrative Costs <br /> <br />Each participant in thc AGUA Plan will be rcsponsible [or paying thc costs associatcd with thc augmcntation of thc wclls. Thesc <br />costs will include: <br /> <br />I. lnactivc Wells: S50 per well. <br />2. Setup cost (ncw members only) [or each active well: SIOO per well. <br />J. Admiuistrative fees for each active well: $205 per well. This fee includes a SI50 admiuistration fee, a $25 loan reserve, and <br />S30 for well re-testing payment plan. Well re-testing is required every four years by the state, There will be a late fee of S JOO <br />per active well in addition to thcse fees for wells signing up between Jan. 15 and Feb. 15. <br />4. Welltcsting, Wcll tcst fees are S/lO for a standard well and S/35 [or a complex well. You will be required 10 pay [or <br />the difference, if othcr costs are involved. You are responsible to know when your nc,,'! welllcst is duc and <br />responsiblc for making arrangcments with the lester. You may choose which tester you would likc, but you must pay <br />for fees in excess ofwbat AGUA has receivcd in well test fees from you. <br />5. Augmentation water fee: per acre-foot of augmentation water required by your well. This amount will be calculated <br />by the acre feet of water needed you provide on the last page of this application, 3.00 <br />6. Acquisition Reservc: money held for purchase o[ water rights, based on an acre-foot charge of SXW multiplied by <br />your dcpletion amoUlll. <br /> <br />Actual costs of the Plan may vary dcpending upon water costs, number of wclls within tilC plan, and possiblc changes in thc <br />admiuistration of the Plan. Membership may be subject to supplemental assessmcnts if necessary. Thcy may also vary depending <br />on whclhcr you arc in or out of the conservancy district andlor the State identified whitc area. <br /> <br />Membership and administrative fees must be received not later than January 15, 1997 and every year after. Tbe augmentation <br />water fee must be paid by March 15, 1997 and evcry year after. Those persons who request a paymcnt plan for their water, in <br />writing and board approved, will be subject to a finance charge of 2% interest per month, <br /> <br />The AGUA Plan will be operated in full compliance with the Division 2 rules, Individual participants must fully comply with thc <br />mcmbership requirements of the AGUA Plan and Division 2 Rules. Participants who fail to do so will be subject to enforcement <br />actions by the Division Engineer's Office. Note: it is suggested to call AGUA if you receive a letter from the Division Engineer for <br />clarification and quality control. Also notify AGUA if there is a change in ownership, user infonnation and change in operations <br />(example: sprinkler and flood percentages etc.). <br /> <br />Page 1 of4 <br />
