Approximately 5,800 shares are issued and outstanding, and <br /> <br /> <br />another 200 shares are treasury shares kept by the company. The 177 FMIC shares offered to AGUA <br /> <br /> <br />would represent a 2.95 percent interest in the company. <br /> <br />The Fountain Mutual Ditch, operated by FMIC, is lJsed for irrigation of lands east of Fountain Creek in <br /> <br /> <br />the Security, Widefield, and Fountain area. The overall length of the ditch is approximately 18 miles. <br /> <br /> <br />Water is diverted from Fountain Creek near the Colorado Springs Wastewater Treatment Plant under <br /> <br /> <br />the water rights previously summarized and delivered through 10 miles of canal to Big Johnson <br /> <br /> <br />Reservoir. Releases have historically been made from the reservoir for irrigation of approximately <br /> <br /> <br />5,000 acres, although the amount of irrigated acre<lge has steadily decreased over the years as <br /> <br /> <br />urbanization has increased and is currently estimated to be 2,000 acres. <br /> <br />Previous change decrees for FMIC shares have found that the ditch is a water short system, and that <br />water deliveries to lands under the system result in naturally reduced irrigation and dry-up of property. <br />Therefore, no dry-up covenant of Fountain Mutual lands has been required, and this finding was <br />upheld in the Supreme Court decision for the Midway Ranch augmentation Plan in Case No. <br /> <br />96SA369. <br /> <br />5 <br /> <br />Janitells' right (FMIC has one-half interest so long as Janitells' carry Priority No. 17 water in the FMIC <br />ditchl. <br /> <br />-16- <br />
