<br />11-4 <br /> <br />ADM IN I STRATI ON <br />The District was formed under the laws of the State of Colorado. It is a <br />quasi-municipality generally having all of the powers and responsibilities <br />of an incorporated Town in Colorado except that its activities are restricted <br />to water and sewer matters. <br /> <br />The Allenspark District has the power of eminent domain, and the power to <br /> <br /> <br />tax property by imposing a mill levy. The District has the power to enter <br /> <br /> <br />into legal contracts for construction and/or acquisition of water and sewage <br /> <br /> <br />facilities. In addition to statute limitations, District activities are <br /> <br /> <br />limited by the Service Plan and by the petition for District formation. <br /> <br />The purposes of the District, as stated in the petition, are "to provide a <br /> <br /> <br />complete water supply, treatment, storage, transmission, and distribution <br /> <br /> <br />system, together with all necessary incidental and appurtenant facilities, <br /> <br /> <br />for said District and inhabitants thereoL" <br /> <br />= <br /> <br />As stated, the District was successfully formed and the original Board of <br />Directors elected as a result of the November, 1972 election. A second elect- <br />ion will be required if bonded indebtedness is to be incurred which could <br />subject real properties to taxes. The estimated water system cost, at the <br />time of District formation, was $192,000. Before any financing plans are <br />finalized, the District's Attorney should be consulted regarding the need <br />to advise the County Commissioners and/or the District Court of current esti- <br />mated costs. <br /> <br />, <br />
