<br />WHEREAS, the Water Upers desire to provide for the <br />continued use of the Pre-Co~pact Reservoirs on the headwaters <br />of the Rio Grande in aid of minimizing Compact over-deliveries <br />by the Rio Grande mainstem and maximizing beneficial uses of <br />_~ompacL-allotted_ water~ in Colorado; <br />WHEREAS, the Water-"Users and the owners of the Pre- <br />Compact Reservoirs, namely the San Luis Valley Irrigation <br />District and the Santa r.1aria Reservoir company, (the "Owners") <br /> <br /> <br />desire to fix a.procedure ~or distribution of water which <br /> <br /> <br />may be stored in Pre-Compact Reservoirs under an account <br /> <br /> <br />denominated "Compact Watersll. <br /> <br /> <br />NOW THEREFORE, it is agreed by the Water Us~rs and <br />Owners that: <br />1. The State Engineer shall maximize the use of the <br />Pre-Compact Reservoirs for the purpose of storing waters <br />which would otherwise be delivered during the irrigation <br />season to ~ew Mexico and Texas, as a means to minimize <br />Compact over-deliveries from the Rio Grande rnainstem and to <br />maximize the ultimate volume.of deliveries of Rio Grande <br /> <br />water to the Water Users. <br /> <br />2. Compact Waters shall be held in storage by the <br />Owners subject ~o the direction and control of the State <br />Engineer during the year such waters are impounded. The <br />State Engineer may .determine in such year that Compact <br />Waters are required for delivery at the colorado-New Mexico <br />state line in order to meet the'obligation imposed on Colorado <br />under Article III of the Rio Grande Compact. If the State <br />Engineer so determines that Compact Waters are required to <br />fulfill Compact obligations, the Owners and the Water Users <br />agree to co-operate to insure releases of Compact Waters in <br />the amounts and at the rates of flow directed by the State <br />Engineer. <br /> <br />- 2 - <br />
