( ;. <br /> <br />WHEREAS, the members of the Rio Grande Water Users <br /> <br />,b..s_sQQi'ltion (the. ".water Users") have suffered large curtailments <br /> <br />. in diversions .by reason--of. administration to assure compliance <br /> <br />with the Rio Grande cornpact;- <br /> <br />WHEREAS, the Water Users recognize that the State of <br /> <br />Colorado has a difficult task in administering the Rio <br /> <br />Grande and its tributaries so as to meet the obligation <br /> <br />imposed by the Rio Grande Compact and by the additional <br /> <br />burden of the terms of the Motion for Continuance and Stay <br /> <br />of Proceedings in Texas and New Mexico v. Colorado ("Motion <br /> <br />and Stay"); <br /> <br />WHEREAS, the State of Colorado's ability to minimize <br /> <br />Compact over-deliveries depends on the use of pre-compact <br /> <br />reservoirs to" regulate flows of the Rio Grande at the Del <br /> <br />Norte and Lobatos gauging stations; <br /> <br />WHEREAS, the Water Users have in past years requested <br /> <br />the State Engineer of Colorado ("State Engineer") to utilize <br /> <br />vacant storage space in Rio Grande, Santa Maria, and Continental <br /> <br />l<eservoirs (the "Pre-Compact Reservoirs") for storage of <br /> <br />waters which otherwise ~he State Engineer would cause to be <br /> <br />delivered at the Colorado-New Mexico state line towards <br /> <br />satisfaction of obligations of the State of Colorado under <br /> <br />the Rio Grande Compact and ,the Motion for Continuance and <br /> <br />Stay in Texas and New Mexico v. Colorado; <br /> <br />"WHEREAS, storage of such waters aids the State Engineer <br /> <br />in minimizing over-deliveries under the Compact and Stay, <br /> <br />and correspondingly allows for the maximum delivery of water <br /> <br />to the Water Users; <br /> <br />WHEREAS, for the years 1979, 1980, and 1981, use of the <br /> <br />Pre-Compact Reservoirs saved for beneficial uses in Colorado <br /> <br />an average annual volume 'of water of 28,000 acre feet; <br /> <br />APPENDIX D <br />
