Authority exists in the law and funds have been budgeted,. appropriated and otherwise made <br />available and a sufficient unencumbered balance thereof remains available for payment by the DWR <br />in Fund Number 167, Organization AASE, Appropriation GWM, Program WTGW, GBL USGS. <br /> <br />B. Required approval, clearance, and coordination have been accomplished from and with appropriate <br />agencies. <br /> <br />C. The Denver Museum of Natural History ("MUSEUM") is coordinating a geo-hydrologic investigation of the <br />Denver Basin aquifers ("STUDY"), which will consist of drilling and coring a 2000 foot research well in the <br />Denver Basin aquifers near Kiowa in the central Denver Basin and conducting a geo-hydrologic analysis <br />of the core and core hole and other analyses. The MUSEUM and the U.S. Geological Survey ("USGS") <br />wiil conduct the STUDY. The CWCB and the DWR (collectively referred to as "the State Agencies") will <br />participate in the STUDY by contributing funds to finance STUOY costs. The USGS will contribute $6,400 <br />and the Colorado Slate University will contribute $10,000 to fund certain portions of the STUDY. <br />Additionally, the National Science Foundation ("NSF") will contribute funds to the STUDY. <br /> <br />D. Pursuant to Section 37-80-111.5 (l)(d), C.R.S. (1998), the DWR is authorized to expend funds from <br />the ground water cash management fund to conduct ground water investigations. <br /> <br />E. The CWCB has agreed to coordinate the disbursement of funds from the State Agencies to the <br />USGS and the MUSEUM for the STUDY, and will enter into a Joint Funding Agreement with Ihe USGS <br />and a Grant Contract with the MUSEUM by which the CWCB will disburse the funds and Ihe USGS <br />and fVluScUM will corduct the STUOY and make the STUDY results available to the State Agencias. <br />The Joint Funding Agreement and Grant Contract are incorporated herein by reference upon their <br />execution and approval. <br /> <br />F. The State Agencies have agreed to implement their portion of the funding of the STUDY through this <br />,'"IOU, which the State Agencies enter into pursuant to the provisions of Sections 37.60-106 and 37. <br />80-102U), C.R.S. (1998). <br /> <br />NOW, TH::,"IEi'ORE. the parties hereby agree that: <br /> <br />1. Funding Commitments and Availability. The DWR will deliver 510,000 to Ihe CWCS within @een <br />(15) working days of the effective date of this ,'"IOU and on July 15 of each fiscal year for i'Y99-00 and <br />FYOQ-01 to apply to STUDY costs. Financial obligations of each of the State Agencies payable after <br />L"18 current fiscal year are contingent upon funds for that purpose being appropriated, budgeted and <br />otherNise made available. <br /> <br />2. Contracts with USGS and MUSEUM.
