<br />WHEREAS, 'J the State and the Contractor did, on September 1, 1979
<br />enter into a contract for the constructioll of a wate): supply system
<br />for the Town of Limon, Colorado, at an estimated cost .of Four Hundred
<br />Fifty Thousand Dollars ($450,DDO) "hich contract is attach"u hereto
<br />as exhibit "Alf, and hereby incorporated into this am2nded contract;

<br />WHEREAS, the State and the Contractor have agreed to amend'the
<br />original contract marked as exhibit IlA" because it is necessary to
<br />spend Seven Hundred Fifty Thousand Dollars ($750,000) in order to
<br />construct part of the project;
<br />
<br />NOW THEREFORE, in consideration of the mutl.tal and dependent
<br />covenants herein contained, it is agreed by the parties hereto as
<br />follOl's:
<br />
<br />1. The tel~S and provision of that certain contract dated
<br />September 1,.1979, attached hereto as exhibit "All and
<br />incorporated herein by reference, remain in full force
<br />and effect except as amended herein,
<br />
<br />2. Paragraph A.9. is hereby amended to read as follmvs:
<br />
<br />9. To purchase from the State all of the State's right, title
<br />and interest in said project and any facilities thereof,
<br />at a total purchase price of One Mill ion 1\vo Hundred
<br />Ninety Seven Thousand Eight Hlmdred Dollars ($1,297,800),
<br />payable in forty (40) annual installments of Thirty 1\,,10
<br />Thousand Four Hundred Forty Five Dollars ($32,445) each,
<br />which first installment shall be due and payable on January
<br />1, 1981 and yearly thereafter until the entire principal
<br />sum shall have been paid, Said installment payment shall
<br />be I.:.J.de payable to the Colorado ~.Jater Conservation Board,
<br />payable at the offices of said board in Denver, Colorado.
<br />
<br />3. Paragraph B.l. is hereby amended as follOl's:
<br />
<br />L Hake available to the Contractor for the purpose of this
<br />contract the sum of Seven Hundred Fifty Thousand Dollars
<br />($750,000). Said Seven Hundred Fifty Thousand Dollars
<br />shall be wade available to the Contractor in accordance
<br />with the following terms, schedule and conditions:
<br />
<br />a. Beginning vlith the monthly period commencing
<br />February 1, 1980.and for every month thereafter
<br />until said project has been completed, the
<br />Contractor shall prepare with the consultii1g
<br />engineer's help an estimate of the funds required
<br />from the State for project construction during
<br />that month and shall forward said estimate to the
<br />State not less than fifteen (15) days prior to the
<br />beginni.ng of such month.
