<br />3. If this contract involves the payment of more than ten thousand dollllrs for tht" construction. erectiol1. repair.
<br />maintenance. or improvement of any building, road, bridge, viaduct, tunnel. excavation or other public work for this
<br />Stale. the contral.:tor shall, before entering upon tht: performance of any such work included in this contra!;;t. duly
<br />executc and deliver to and file ,with the official whose signature appears below for the State, a good and '~ufficient
<br />bond or otht:r acceptable surety to be approved by said official in a penal slim not less than one-half of the lotal
<br />amount payable: by the terms of Ihis conttacl. Such bund shall be duly executed by a qualified corporate surety,
<br />conditioned for the due and faithful performance of the contract, and in addition. shall provide that if the contractor or
<br />his subconttact()rs fail to duly ptly for any Iqbor, matcrials. learn hire, sUStenance, provisions. provender or other
<br />supplies used or consumed by such contractor or his subcontr:lctor in pefonnance of the work cOnuacled to be done,

<br />MINIMUM WAGE

<br />4. Except as otherwise provided by law. if this contract provides for the paymeut of more th3n five lllousand
<br />dollars and requires or involves the employment of laborers or mechanics in the constrllction. alteration or repair of
<br />any building Or other public work. (except highways, highway bridges. underp3SSes and highway structures of all
<br />kinds) within the geog,raphicallimits of the State. the nlte of wage for all laborers and mechanics employed by the
<br />contracto'r or ~ny subconlractor on the build.ing or public work co\'ered by "this contr<Jct shall be nol less than the
<br />prevailing rate of wages for work of a similar nature in the cilY, town, village or other civil subdivision of th~ St:lte in
<br />which the building or other public work is Illcated. Disputes respecting prevll:iling rales will be resolved as prtJvided in
<br />8.16-101. CRS 1973. as amended.

<br />(I) The conlractor will not discriminate against any employee or applicant for employment btcause of

<br />Ordtr. Equal Opportunity and Affinnative Action. dated April 16. 1975. and of the rules. regulations. and
<br />relevant Ordel"$ of the Governor.
<br />(4) The contl"3ctor and labor unions will furnish all information and reports required 'by Executive Order.
<br />Equal Opportu.nity and Affirmative Action of April 16. 1975. and by the roles, regulations and Orders of the
<br />Govemor. or pursuant thereto, and 'will permit access to his books. records. ant! accounts by the contr.lcting
<br />agency and the office of Ihe Governor or his designee for purposes of investlg:Jtion to ascertain compliance
<br />with such rules, regulations and orders.
<br />(5) A Jabor organization will not exclude any individual otherwise qualified from full membership rights in
