Water made available <br />to the City from its ownership of shares in Marshall Lake Division must be <br />used during the historical irrigation season at times when the Community Ditch <br />is diverting water to other water users. Therefore, the City's ownership of <br />shares in Marshall Lake cannot be used for a winter water supply according to <br />the current by-laws of FRICO. Should the City not use its allocation of water <br />during a particular .irrigation season, such water may be carried over to sub- <br />sequent years, however, should Marshall Lake fill under its own storage decrees, <br />any water carried over from previous years reverts back to the common ownership <br />of the irrigation company. Since carry-over water would be lost should Marshall <br />Lake fill under its own storage decrees, such carry-over storage made available <br />by the City's ownership of 103.54 shares will provide a dependable supply of <br />694 acre-feet. <br />Under the special agreement with FRICO, the City has the right to utilize <br />all unused capacity of the Community Ditch and Marshall Lake in preference over <br />any other municipality or other water user except for FRICO. Since the lake <br />fills only in very wet years, and since there is normally significant amount of <br />available storage capacity, the lease and exchange agreement with FRICO serves <br />somewhat to reduce the amount of raw water storage the City must acquire. <br />The lake will be a considerable benefit to the City even in those years when <br />it fills under its own decrees. Such is the case since FRICO normally starts <br />releasing water from Marshall Lake for irrigation during the early part of <br />May. Releases are usually in large volumes of usually over 100 acre-feet per <br />day which thereby create surplus capacity at a sufficient rate to allow storage <br />of large quantities of water available to the City during the months of May and <br />June. <br /> <br />24 <br />
