<br />if <br /> <br />. <br /> <br />. <br /> <br />; <br /> <br />The Contractor shall then determine, describe, and document <br />(complete with statutory citations) which of these entities would <br />have the power to carry out the following activities and assume <br />the following obligations: <br /> <br />1. obtain and grant to the Bureau rights-of-way and <br />easements for the construction of the piped laterals by <br />the Bureau, <br /> <br />2. contract with the Bureau to actually construct the piped <br />laterals with funding provided by the Bureau (the Bureau <br />desires to complete construction in this manner, but <br />will not require it), <br /> <br />3. provide access to the Bureau or the Board to annually <br />inspect the piped laterals after they are constructed, <br /> <br />4. operate and maintain the completed laterals at the <br />expense of the lateral organization, and <br /> <br />5. in all other respects meet the requirements of the <br />Colorado River Basin Salinity Control Act. <br /> <br />For those entities which are found to have the powers and <br />authorities to perform or meet the requirements of items 1, 3, 4, <br />and 5 above, the Contractor shall research, describe, and <br />document (complete with statutory citations) what procedures <br />would have to be followed to establish each such entity or, if <br />such an entity already exists in the Grand Valley, what steps <br />would have to be taken by such entity to undertake the <br />organization of the subject laterals. The Contractor shall <br />comment on the relative advantages and disadvantages of <br />establishing each such entity or of having existing entities <br />assume responsibility for the laterals. <br /> <br />Representatives of the Bureau and the State shall be <br />available to the Contractor at no expense to review the <br />requirements of federal law and such other matters as may be of <br />assistance to the Contractor in the conduct of its research. <br /> <br />Work activity shall include up to 10 hours of meetings with <br />the State and other parties to review and discuss the <br />Contractor's findings and the steps to be taken in organizing the <br />laterals. <br /> <br />Report <br /> <br />The Contractor shall write a full and complete report for <br />the State which details and thoroughly documents its research and <br />conclusions on the matters set forth above. This report shall <br />include complete statutory citations to the relevant federal law <br />and to the enabling statutes for the different kinds of entities <br />which can be established under Colorado law. <br /> <br />-2- <br />
