WHEREAS, authority exists in the law and Funds have been budgeted. appropriated and otherwise made
available and a sufficient unencumbered balance thereof remains available for payment in Fund Number 1001 .

WHEREAS. required approval. clearance and c~ordination has been accomplished from and with appropriate
agencies: and .

WHEREAS, the State of Colorado supports the basinwide
approach to the control of salinity in the Colorado River Basin
which has been adopted by the federal government and the seven
Colorado River Basin states; and

WHEREAS I the Colorado Water Conservation Board (State) is
the lead agency for Coloradols participation in the Colorado
River Basin salinity control program; and

WHEREAS I completion of the "Grand Valley Salinity Control
Unit by the U.S. Bureau of Reclamation (Bureau) requires that the
private laterals in the Grand "Valley be organized into entities
with which the Bureau can contract for the laterals' operation
and maintenan~e; and

WHEREAS, the Bureau has requested that the State undertake
an investigation of alternative means for accomplishing the
needed organization of" such lat~rals and will reimburse the State
for its costs in performing such an investig,ation; and

WHEREAS, the Attorney General has consented to the use of
private "legal counsel by the Colorado Water Conservation Board
for this investigation pursuant to section 37-60-114, CRS; and

WHEREAS, the law firm of Dufford, Waldeck, Ruland & Milburn
(Contractor) was ,the" low bidder in invitation number ERR42484 on
April 24, 1985, and

WHEREAS, section 24-101-101, et seq., Colorado R~vise~
Statutes, as amended, has been fully 'complied with.

NOW THEREFORE, BE IT RESOLVED THAT:

1. The State will compensate the Contractor the sum of
Eight Thousand Dollars ($8,000) for the legal research described
in Exhibit A. The Contractor will further be reimbursed for
actual costs, not to exceed One Thousand Dollars ($1,000) for
travel, lodging, mealsl and long distance telephone charges
incurred in the conduct of the work required to be performed by
Exhibit A.

2. The Contractor will complete the investigation and
submit the report specified in Exhibit A per the schedule set
forth in Exhibit A.
