Colorado 81428. <br />hereinafter referred to as the contractor/Contractor or Borrower. <br /> <br />WHEREAS, authority exists in the Lawand Funds bave been budgeted, appropriated and otherwise made available and a sufficient <br />unencumbered balance thereof remains available for payment in Fund Number 424 . 9rganizatiOD YYYY . Contract Encumbrance Number; C, I :-, ",(" 'I' ; and <br /> <br />WHEREAS, required approval, clearance and coordination have been accomplished from and with appropriate agencies; and <br /> <br />WHEREAS, pursuant to the provisions of section 37-60-119, <br />Colorado Revised statutes, as amended, the State is authorized <br />to construct certain water projects for the benefit of the <br />people of the State of Colorado; and <br /> <br />WHEREAS, the Beaver Reservoir Company has made application <br />to the State for the improvement of its existing facility, such <br />improvement of the facility is hereinafter sometimes referred to <br />as the project; and <br /> <br />WHEREAS, the Contractor is a reservoir company incorporated <br />within the State of Colorado; <br /> <br />NOW THEREFORE, it is hereby agreed that: <br /> <br />1. The Contractor shall have a feasibility report prepared, <br />directed to the problem of improving the facilities of the <br />Beaver Reservoir Dam, in accordance with a proposal for a <br />project feasibility report prepared by the consulting <br />engineering firm of Woodward-Clyde Consultants (the Consultant) <br />and approved by the state, received June 26, 1992, which <br />proposal is attached hereto as Appendix A and made a part of <br />this contract. <br /> <br />2.
