Cause construction of the Project to be completed <br />within two (2) years of the date of this Contract, in accordance <br />with the Project plans and specifications and any necessary <br />modification(s) thereof approved by the State. This time may be <br />extended by the State in writing if such time is insufficient <br />because of acts of God or other acts or circumstances beyond the <br />control of the Contractor. The Contractor must produce <br />documented Justification of any such acts or circumstances. <br /> <br />4. Require all Construction Firms and their subcontractors <br />to indemnify the State and the Contractor against all liabi1lity <br />and loss, and against all. claims and actions based upon or <br />arising out of damage or injury, including death, to persons or <br />property, caused by any acts or omissions of those parties or <br />sustained in connection wi th the performance of any contract <br />related to the Project or by conditions creat.ed thereby, or based <br />upon any violation of any statute, ordinance, or regulation, and <br />the defense of any such claims or actions. <br /> <br />5. Require all Construction <br />to maintain during the term of <br />construction the following: <br /> <br />Firms and their subcontractors <br />their contracts for project <br /> <br />a. Workerls compensation and employer's <br />insurance in the required statutory amounts. <br /> <br />liability <br /> <br />b. Automobile liability insurance for all vehicles, and <br />comprehensive general liability insurance, both in at least <br />the following amounts: <br /> <br />(1) For any injury to one person in any single <br />occurrence, the sum of $500,000.00. <br /> <br />(2) For any injury to two or more persons in any <br />single occurrence, the sum of $1,000,000.00. <br /> <br />(3) For any damage to property, the sum of $400,000.00 <br />for each occurrence. <br /> <br />Said general liability insurance shall name the Contractor <br />and the State as co-insureds. No payments shall be made to <br />the Contractor under this Contract unless copies of current <br />certificates of all such insurance have been obtained by the <br />Contractor and filed with the State. Such filing of current <br />certificates shall be accomplished before the beginning of <br />construction. Notices of renewals of said policies shall <br />also be filed with the State as they occur. <br /> <br />6. Without expense to the State, manage, operate and <br />maintain the Project continuously in an efficient and economical <br />manner, and assume all legal liability for such management, <br />operation and maintenance. The Contractor agrees to indemnify <br />and hold the State harmless from any liability incurred by the <br />State . as a .r:esl!lt ot the St.ate I s intecest in the Project <br />facilities and any other property identified in paragraph A.14. <br />below. The Contractor shall maintain comprehensive general <br />liability insurance covering the management, operation and <br />maintenance of the Project from the time it accepts the <br />constructed Project as substantially completed until it completes <br />repayment to the State, in at least the following amounts: <br /> <br />a. For any injury to one person in any single occurrence, <br />the sum of $150,000.00. <br /> <br />b.
