I

I

I

in this reservoir except water diverted under the legal authority of
water rights previously appropriated and owned by the City of Delta,
no filing for storage of water in the White Stabilization Reservoir
has ever been made. The City of Delta is advised to reexamine this
understanding in light of the present municipal usage and seek a
qualified legal opinion on the matter. It is our opinion that a water
right would enhance the City's holdings and would insure continued
use of the site.

I

I

I

The Morris Reservoir No. 2 was purchased in 1965 from Naomi
Hart. This reservoir is located on the headwaters of Oak Creek. The
reservoir has absolute decrees for a total of 16.33 acre-feet and a
conditional decree for 13.67 acre-feet. The original dam was con-
structed in 1911 with a height of 9 feet. In 1950, the dam was
reconstructed to a height of 10 feet. In order to make the
conditional decree absolute, it would be necessary to raise the dam
five more feet. This conditional decree has been continued by the
State Engineer to August 1978.

I

I

The Howard Reservoir has absolute decrees for 72.7 acre-
feet and a conditional decree for 47.3 acre-feet. This reservoir
is located on Kennicott Slough, a tributary to Kaiser Creek.
This location is out of the normal watershed and gathering area of
the City of Delta collection system. Water from this reservoir is
used on a trade basis for an equal amount of water from the Granby
Ditch and Reservoir Company. The conditional status has been con-
tinued by the State Engineer to August 1978.

I

I

I

The
acre-feet
chemical
raw water

Delta Control Reservoir has an absolute decree for 34.04
and is located at the end of the collection system near the
treatment works. The reservoir is supplied only by Delta's
transmission pipelines from Grand Mesa.

I

I

I

I

I

I

I

II - 21

I
