<br />I <br /> <br />I <br /> <br />I <br /> <br />the City <br />for this <br />The City <br />irrigation <br /> <br />has asked for and received an alternate point of diversion <br />right at the City's headgate on Dirty George Creek. <br />has also received a change of character of use from <br />to irrigation, domestic, and municipal purposes. <br /> <br />I <br /> <br />The Oak Valley Ditch has an absolute decree for 1.25 c.f.s. <br />and the Oak Valley Ditch first enlargement absolute decree for <br />0.65 c.f.s. from Oak Creek. These water rights were acquired by the <br />City in 1964 with the purchase of the Carl White Ranch and are for <br />irrigation purposes. <br /> <br />I <br /> <br />I <br /> <br />The recent Court Case No. W-1691 gave the City of Delta <br />a change in character of use from irrigation to irrigation, domestic, <br />and municipal purposes at an alternate point of diversion at the <br />proposed Oak Creek Pipeline intake. In this same case the Court <br />declared that a previous conditional decree for 2.75 c.f.s. in the Oak <br />Valley Ditch was abandoned. The Oak Creek Pipeline is to be construc- <br />ted in the coming summer of 1975. When installed, the City will have <br />the legal right to divert into the pipeline up to 0.31 c.f.s. under <br />the Oak Valley Ditch priority and up to 0.16 c.f.s. under the <br />enlargement priority for municipal, domestic, and irrigation use. <br /> <br />I <br /> <br />I <br /> <br />I <br /> <br />The Teachout Ditch carries an absolute water right for 3.30 <br />c.f.s. from Oak Creek for irrigation use under an early priority. The <br />rights for this water were obtained with purchase of the White Ranch <br />in 1964. However, since the original headgate has been washed out for <br />over 20 years, the water has for some time been picked up at other <br />locations for use on the ranch. Recently the City was granted an <br />alternate point of diversion under this water right at the proposed <br />Oak Creek Pipeline and a change in character of use to include <br />irrigation, domestic, and municipal purposes. To provide for any <br />adverse affect the City will be limited to the right to divert only 25 <br />percent of the original decree, or up to 0.825 c.f.s., at the <br />alternate point during the irrigation season. <br /> <br />I <br /> <br />I <br /> <br />I <br /> <br />I <br /> <br />The Oak Creek No. 2 Ditch has an absolute decree for 2.425 <br />c.f.s. from Oak Creek for irrigation purposes. The decree was <br />also purchased with the White Ranch in 1964. The City has been <br />granted an alternate point of diversion at the proposed Oak Creek <br />Pipeline and a change in character of use to include domestic, <br />municipal, and irrigation purposes. Only 25 percent of the original <br />decree, or up to 0.61 c.f.s., may be legally diverted at the alternate <br />point during the irrigation season. <br /> <br />I <br /> <br />I <br /> <br />I <br /> <br />Louck's Ditch has an absolute decree for 0.5375 c.f.s. from Oak <br />Creek and is used to irrigate a portion of the lower areas on the <br />former Carl White Ranch now owned by the City of Delta.
