The only regularly operated <br />diversion within this reach of stream is the Baldy Ditch, decreed for 30 cfs. The Division of <br />Water Resources reports that this ditch usually completes its diversions for the irrigation season <br />by the end of June, and the design of the diversion structure allows sufficient flows to pass to <br />sustain the downstream fishery. Based on this analysis, staff has determined that water is <br />available for appropriation on East Fork Dry Creek, between the confluence with Beavers Dam <br />Creek and the confluence with the West Fork Dry Creek, to preserve the natural environment to <br />a reasonable degree without limiting or foreclosing the exercise of valid existing water rights. <br /> <br />- 5 - <br />
