The summer flow recommendation was <br />reduced to 4.0 cfs for the time period of July I through July 31 based on limited water <br />availability. Table 3 also shows that the winter flow recommendation of 7.3 cfs is not available <br />at least 50% of the time through the winter period. The winter flow recommendation was <br />reduced to 1.5 cfs for the period of August 1 to February 28 and to 4.0 cfs from March 1 through <br />March 31 based on limited water availability. <br /> <br />Existing Water Right Information <br /> <br />Staff has analyzed the water rights tabulation and consulted with the Division Engineer Office <br />(DEO) to identify any potential water availability problems. There are no decreed surface <br />diversions within the upper reach of stream and no surface diversions within the lower reach of <br />stream. However, there are water rights located between these two stream reaches, but return <br />flows from irrigation accrue to the creek before the upper terminus of the lower reach. Based on <br />this analysis staff has determined that water is available for appropriation on Escalante Creek, <br />between the confluence of the East and Middle Forks and the Knob Hill Ditch, to preserve the <br />natural environment to a reasonable degree without limiting or foreclosing the exercise of valid <br />existing water rights. Based on this analysis, staff has also determined that water is available for <br />appropriation on Escalante Creek between the confluence with the North Fork and the headgate <br />of the Captain H.A. Smith Ditch, to preserve the natural environment to a reasonable degree. <br /> <br />- 7- <br />
