Statements of Opposition: A Statement of Opposition was filed by the <br />City and County of Denver acting by and through its Board of Water <br />Commissioners; and by the Middle Park Water Conservancy District. No <br />other Statements of Opposition have been filed and the time for filing such <br />statements has now expired. <br /> <br />c. Summary of Consultation: On April 19, 1991, the Division Engineer for <br />Water Division No.5 submitted a Summary of Consultation stating that the <br />Application appears to be adequate and recommending that the Application <br />should be issued by the Court as a ruling. The Court has given this <br />recommendation due consideration. <br /> <br />d, Resolution of Statements of Opposition: All parties filing Statements of <br />Opposition have either reached Stipulations with CWCB, withdrawn <br />their Statement of Opposition, or otherwise approved the terms <br />contained herein. <br /> <br />e. Protests to Referee's Ruling: The Referee entered a Ruling in this case <br />on April 2, 1999. Trout Unlimited and City and County of Denver <br />acting by and through its Board of Water Commissioners filed timely <br />protests to this matter. All parties filing Protests have either reached <br />Stipulations with CWCB, withdrawn their Protest, or otherwise <br />approved the terms contained herein. <br /> <br />3, Requested Water Right: The CWCB appropriated the Instream Flow more <br />fully described as follows <br /> <br />a. Source: The source of the water is SI. Louis Creek. <br /> <br />b, Location: <br /> <br />Legal description of the two stream segments through which an instream <br />flow is claimed: (1) Upper segment: the natural stream channei from the <br />confluence with East SI. Louis Creek at latitude 39053'50" North and <br />longitude 105052'55" West as the upstream tenninus and extending to the <br />. confluence with West St, Louis Creek; and (2) lower segment: the natural <br />stream channel from the confluence of West St. Louis Creek extending to <br />the confluence with King Creek at latitude 39054'52" North and longitude <br />105052'27" West as the downstream terminus, The total distance of both <br />segments is approximately 1.3 miles, These segments can be located on the <br />Bottle Pass and Fraser U.S.G.S, quadrangles. <br /> <br />Administration: For the stream segments in an unsurveyed area, the <br />Division Engineer has determined for administrative purposes that the <br />approximate legal description of the instream flow termini as protracted <br />from U.S.G.S. mapping is as follows: upstream terminus in the SE/4 SW/4 <br />
