FINDINGS OF FACT, CONCLUSIONS OF LAW, JUDGMENT AND DECREE

IN THE MATIER OF THE APPLICATION FOR WATER RIGHTS OF THE
COLORADO WATER CONSERVATION BOARD ON BEHALF OF THE
PEOPLE OF THE STATE OF COLORADO,

IN ST, LOUIS CREEK, A NATURAL STREAM,

IN THE WATERSHED OF THE COLORADO RIVER

This matter comes before the Court on the Application for Water Rights of the
Colorado Water Conservation Board (CWCB) to grant its Application for an instream
low water right in 5t. Louis Creek.

The Court has reviewed the Application, has reviewed all other pleadings in the file,
has made such investigations as are necessary to determine whether the statements in the
Application are true, and as a result is fully advised in the premises, and does hereby enter
the following Judgment and Decree:

2. History of the proceedings:

a. Notice and Jurisdiction: The CWCB filed the above entitled Application
with the Court on December 28, 1990, The case was referred to the Water
Court for Water Division No,S in accordance with the provisions of C.R.S,
p7-92-101, et seq. (1990 Repl. Vol. IS).

Timely and adequate notice of this proceeding has been given in the manner
required by law. The Court has jurisdiction over the subject matter of this
proceeding and over all who have standing to appear as parties, whether they
have appeared or not.
