STIPULATION

IN THE MATTER OF THE APPLICATION FOR WATER RIGHTS OF THE
COLORADO WATER CONSERVATION BOARD,

IN BOULDER COUNTY, COLORADO.

Applicant the Colorado Water Conservation Board
(-CWCB-), and objectors the City of Longmont (-Longmont-) and
the Highland Ditch Company (-Highland-), by and through their
respective undersigned attorneys, hereby stipulate and agree as
follows:

RECITALS

A. The CWCB filed the subject cases on December 21,
1987, concerning the following stream reaches: Case No. 87CW278
involves South st. Vrain Creek from the confluence with Middle
st. Vrain Creek downstream to the headgate of Longmont's South
pipeline; Case No. 87CW282 involves North st. Vrain Creek from
an unnamed tributary below Button Rock Dam downstream to the
confluence with South st. Vrain Creek; and Case No. 87CW283
involves South st. Vrain Creek from the headgate of Longmont's
South Pipeline downstream to the confluence with North st. Vrain
Creek (hereinafter the -CWCB Cases-I.

B. Longmont filed timely statements of opposition in
Case Nos. 87CW278, 87CW282 and 87CW283; Highland filed a
statement of opposition in Case No. 87CW282 only.

C. Longmont has filed applications, and in certain
cases obtained decrees, inVOlving North and south st. Vrain
Creeks in the following cases:

86CW395 (Union Reservoir Exchange);
87CW212 (Longmont SQPply Ditch Transfer) (decreed);
87CW213 (Rough and ~eady Ditch Transfer) (decreed);
87CW214 (Oligarchy Oitch Transfer) (decreed);
87CW215 (Beckwith Ditch Transfer);
87CW216 (Clover Basin Ditch Transfer);
87CW218 (Niwot DitCh Transfer);
87CW219 (Pella DitCh Transfer);
