Board law that the entry of this Ruling approving this instream flow water right will not injuriously affect the owner of or persons entitled to use water under a vested water right or decreed conditional water right. 12. The Applicant has complied with all requirements, has met all standards and burdens of proof regarding the appropria- tion of the instream flow water right requested in this Applica- tion, and is therefore entitled to a Ruling confirming and approving an instream flow water right as more fully described above. RULING 13. The foregoing Findings of Fact and Conclusions of Law are approved and incorporated herein by reference. 14. The Referee rules that this Application should be granted and an absolute decree for 7.0 c.f.s. (March 1 - April 30); 3.5 c.f.s. (May 1 - June 15); 1.5 c.f.s. (June 16 - October 31); 3.5 c.f.s. (November 1 - February 29) is hereby awarded for the purpose of maintaining an instream flow to preserve the natural environment to a reasonable degree in the stream reach between the upstream and downstream points as described above and with an appropriation date of December 22, 1994. The priority herein awarded was filed in the water court in the year of 1994 and shall be junior to all priorities filed in previous years. As between all rights filed in the same calendar year, priorities shall be determined by historical date of appropriation and not affected by the date of entry of ruling. The Applicant shall install and maintain such measuring devices and keep such records as the Division Engineer may require for administration of this right. It is accordingly ORDERED that this Ruling shall be filed with the water clerk subject to Judicial review. It is filed with further ORDERED that a copy of this Ruling shall be the Division Engineer and the state Engineer. this JJf!2 day of St.n/-. I 1995. Dated 3 /
