Legal description of the stream segment through which <br />an instream flow is claimed: <br /> <br />The natural stream channel from the conflu- <br />ence of an unnamed tributary in the NW/4, <br />SE/4, Sec. 25, T8S, R66W, 6th P.M. as the <br />upstream terminus and extending to the John <br />JOnes Ditch in the SW/4, SE/4, Sec. 10, T8S, <br />R66W, 6th P.M. as the Qownstream terminus, <br />being a distance of apProximately 4.5 miles. <br />This segment can be lOCated on the Russell- <br />vil1e Gulch and Castle Rock South U.S.G.S. <br />quadrangles and is depicted on Exhibit A. <br /> <br />5. USe of the water: For instream flows to pre~erve the <br />natural environment to a reasona~le degree. <br /> <br />6. Date of initiation of qppropriation: December 22, 1994. <br /> <br />7. The water was first ap~lied to the above beneficial use <br />on December 22, 1994, by action 0f the Colorado Water Conserva- <br />tion Board pursuant to ~~ 37-92-~02(3), 37-92-103(3), 37-92-103 <br />(4), and 37-92-103(10),15 C.R.S. (1990). <br /> <br />8. Amount of water claimeq: 7.0 c.f.s. absolute (March 1 - <br />April 30); 3.5 c.f.s. absolute (May 1 - June 15); 1.5 c.f.s. <br />absolute (June 16 - October 31); and 3.5 c.f.s. absolute (Novem- <br />ber 1 - February 29). <br /> <br />CONCLUSIONS OF LAW <br /> <br />9. The foregoing Findings of Fact are incorporated herein <br />to the extent that they constitute conclusions of law. <br /> <br />10. The Court has jurisdiction over this proceeding. The <br />Applicant has complied with the ~equired statutory requirements, <br />full and adequate notice of the hpplicant's claim has been given <br />in the manner required by law anQ no additional notice needs to <br />be given.
