<br />},; <br />I <br /> <br />W-3H08, Hot Creek, <br /> <br />(c) There is no point of diversion as such, and <br /> <br />none is claimed. The minimum stream flow right claimed is in <br /> <br />Hot Creek, fro~ its headwaters to its confluence with La Jara <br /> <br />Creek; a distance of ~ miles, in <br /> <br />Canejas County. The stream <br /> <br />in which such minimum flow water right is claimed is a tributary of <br /> <br />the <br /> <br />La Jara <br /> <br />Creek. <br /> <br />Cd) There is no means of diversion, the claim being to a <br /> <br />5.0 cubic feet of water per second of <br /> <br />minimum stream flow of <br /> <br />time, in place in the stream bed. <br /> <br />(e) The date of initiation of such appropriation <br /> <br />pursuant to the action of applicant under the provision of C,R.S. <br /> <br /> <br />1973, Section 37-92-102 (3), and 37-92-103 (3), (4) and (10) is <br /> <br />January 19, <br /> <br />1977, on which date the water of said stream was first <br /> <br />applied to beneficial use to maintain the minimum stream flow required <br /> <br />to preserve the natural environment to a reasonabl~ degree. <br /> <br />(f) In accordance with the Stipulation entered into <br /> <br />betweep the applicant and objectors~ filed on November 21, 1979, <br /> <br />it is further found that the applicant's rights as granted herein <br /> <br />.are subject to any senior rights of the objectors in the subject <br /> <br />source as may be determined by the laws of the State of Colorado. <br /> <br />(g) That applicant i~ entitled to an absolute in place <br /> <br />minimum stream flow water right for such beneficial use with a <br /> <br />priority date of January 19 <br /> <br />, 1977. <br /> <br />THEREFORE, IT IS RULED AND ORDERED'that the application <br /> <br />herein be ~nd it is hereby granted, and that applicant is awarded <br /> <br />an absolute in place minimum stream flow water right for 5.0 <br /> <br />cubic feet of water per second of time in <br /> <br />Hot <br /> <br />Creek, with a <br /> <br />priority date of <br /> <br />Jan uary 19, <br /> <br />1977 for the purpose of <br /> <br />~- - - <br />maintaining the minimum stream flow as required to preserve the <br /> <br />natural environment to a reasonable degree, unconditionally; subject, <br /> <br />however, to all priority rights of senior appropriators of water in <br /> <br />the affected watershed. <br /> <br />-2- <br />
