},; I W-3H08, Hot Creek, (c) There is no point of diversion as such, and none is claimed. The minimum stream flow right claimed is in Hot Creek, fro~ its headwaters to its confluence with La Jara Creek; a distance of ~ miles, in Canejas County. The stream in which such minimum flow water right is claimed is a tributary of the La Jara Creek. Cd) There is no means of diversion, the claim being to a 5.0 cubic feet of water per second of minimum stream flow of time, in place in the stream bed. (e) The date of initiation of such appropriation pursuant to the action of applicant under the provision of C,R.S. 1973, Section 37-92-102 (3), and 37-92-103 (3), (4) and (10) is January 19, 1977, on which date the water of said stream was first applied to beneficial use to maintain the minimum stream flow required to preserve the natural environment to a reasonabl~ degree. (f) In accordance with the Stipulation entered into betweep the applicant and objectors~ filed on November 21, 1979, it is further found that the applicant's rights as granted herein .are subject to any senior rights of the objectors in the subject source as may be determined by the laws of the State of Colorado. (g) That applicant i~ entitled to an absolute in place minimum stream flow water right for such beneficial use with a priority date of January 19 , 1977. THEREFORE, IT IS RULED AND ORDERED'that the application herein be ~nd it is hereby granted, and that applicant is awarded an absolute in place minimum stream flow water right for 5.0 cubic feet of water per second of time in Hot Creek, with a priority date of Jan uary 19, 1977 for the purpose of ~- - - maintaining the minimum stream flow as required to preserve the natural environment to a reasonable degree, unconditionally; subject, however, to all priority rights of senior appropriators of water in the affected watershed. -2-
