THIS MATTER coming on to be heard this day before the

undersigned Referee, pursuant to Order of Re-Referral herein, and

upon examination of the records and files herein, and upon his

inv,estigation, hereby makes the following Findings and Rulings
therein:

(1) That the application of the Colorado Water Conservation

Board on Behalf of the People of the State of Colorado, for a

minimum stream flow water right, was filed on

December 30

. 1977.

(2) That the Water Clerk for Water Division 3 issued and

caused a resume of said application to be published and mailed as

required by stat-ute.

(3) That the time for filing statements of opposition

expired on February 28, 1978, and two statements of opposition were
timely filed herein. A Stiputation was entered between George W.

Woodard on behalf of Charles R. Steed and Chapman, Chapman, &

Keffler; and Connie Peterson on behalf of the applicants, The

-Colorado Water Conservation Board on Behalf of the People of the

State of Colorado in regard to this.

(4) That the Referee finds the facts as follows:

(a) The name of the stream is
