Applicant shall not oppose, object to or protest a change in <br />point of diversion of an absolute water right upstream from its <br />decreed point of diversion to a new point of diversion within the <br />reach of the minimUlll stream flow decree applied for, when the owner <br />of such water right (a) is entitled to extend the head of such <br />ditch upstream pursuant to the provisions of C.R.S. 37-86-111, or <br />(b) seeks to improve the grade and location of all or part of the <br />ditch as necessary to receive and deliver for beneficial use the <br />proper inflow of water to which it may be entitled from such <br />stream. <br /> <br />11. The water right herein awarded is awarded absolutely and <br />unconditionally: subject, however, to all earlier priority rights <br />of others and to the integration and tabulation by the Division <br />Engineer of such priorities, and to changes in accordance with law. <br /> <br />It is accordingly Ordered that this Ruling shall be filed with <br />the Water Clerk Subject to Judicial review. <br /> <br />It is further ORDERED that a copy of this Ruling shall be <br />filed with the appropriate Division Engineer and the state <br />Engineer. <br /> <br />Dated d'~ ~ ~Cfq 3 . <br /> <br />BY THE REFEREE <br /> <br />/5/ Daniel R, Birch <br /> <br />Daniel R.
