RULING OF REFEREE AND DECREE OF THE WATER COURT

IN THE MATTER OF THE APPLICATION FOR WATER RIGHTS OF
THE COLORADO WATER CONSERVATION BOARD ON BEHALF OF
THE PEOPLE OF THE STATE OF COLORADO

IN JOE WRIGHT CREEK, A NATURAL STREAM

IN THE WATERSHED OF THE CACHE LA POUDRE RIVER

IN LARIMER COUNTY.

This Application was filed on December 21, 1987, and was
referred to the Water Referee for Water Division No.1, in accor-
dance with C.R.S. 37-92-101, et seq. All notices required by law
of the filing of this Application have been fulfilled and the
Referee has jurisdiction of this Application. A Statement of
Opposition was filed by the City of Thornton, the City of Fort
Collins and Excalibur Resources Company. On March 31, 1988, the
Division Engineer submitted a Summary of Consultation recom-
mending approval of the Application. The City of Thornton has
withdrawn its Statement of Opposition.

The Referee having made such investigations as are neces-
sary to determine whether the statements in the Application are
true has become fully advised with respect to the subject matter
of the Application.
