<br />, <br /> <br />to prevent injury within any segment of the Lower Blue <br />instream flow rights. Inundation of any stream segment by <br />construction of a reservoir shall-not constitute injury to the <br />Lower Blue instream flow rights for purposes of this <br />subparagraph. <br /> <br />2. The Board shall have the right to file a <br />statement of opposition to any application involving the <br />county Users Pool only to ensure that the terms and conditions <br />of this Agreement are met. In addition, the Board shall have <br />the right to file a statement of opposition with respect to <br />those portions of any application, which exceed or do not <br />involve the County Users Pool; provided, however, that the <br />Board may not use the ~ower Blue instream flow rights as the <br />basis to oppose any application involving the portions of the <br />3,100 Acre Feet included in the presently decreed augmentation <br />and exchange plans of the Snake River Water District and Blue <br />River Water District (Case Nos. 84CW682 and 85CW567, <br />respectively) to the extent such application seeks new or . <br />alternate diversion points within the Snake River and Blue <br />River service areas (including any future eastward or upstream <br />expansion of the Snake River Water District service), or seeks <br />to substitute a new, existing augmentation source for the <br />presently decreed augmentation source so long as there is no <br />overall increase in total depletions from the amounts <br />presently'decreed. <br /> <br />-6- <br />
