<br />, <br /> <br />.' <br /> <br />of, will not be injured by, and need not be protected from <br />injury in connection with any application for a water right, <br />change of water right, or plan for augmentation or exchange <br />involving (directly or by exchange) the county Users Pool, <br />irrespective of the augmentation or replacement source, so <br />long as the following conditions are met: <br /> <br />(a) The applicant for a water right, change of <br /> <br />water right, plan for augmentation, or exchange has contracted <br /> <br /> <br />with the county or its successors, assigns or designees for a <br /> <br />portion of the county Users Pool and is in compliance with the <br /> <br /> <br />terms of such contract; and <br /> <br />(b) The relevant terms and conditions of <br />paragraphs J through 6 of the Summit County Agreement are met <br />and incorporated into any future applications and all decrees <br />involving the County Users Pool; and <br /> <br />(c) EITHER, <br />(1) the application involving the County <br />Users Pool is in compliance with the terms and, conditions of <br />Appendix C and Table 1 thereof; <br />QB, <br />(2) such application either does not <br />injure the Lower Blue instream flow rights, or includes terms <br />and conditions and, if necessary, provides augmentation water <br /> <br />-5- <br />
