CONCERNING THE APPLICATION FOR WATER RIGHTS OF THE COLORADO WAH:R
CONSERVATION BOARD ON BEHALF OF THE PEOPLE OF THE STATE OF
COLORADO

IN GOLD CREEK, A NATURAL STREAM

IN THE WATERSHED OF THE GUNNISON RIVER

IN GUNNISON COUNTY

THIS MATTER, having come on before the court on the appl i-
catIon of the Colorado Water Conservation Board and the court
being fully advIsed as to the matter of the applIcation herein,
hereby makes the following findings:

The application herein was filed with the water clerk,
water Division 4 on May 13, t980. All notices required by law
for the ftling of this application have been fulfilled, and the
court has jurisdiction over the appl icatlon.

The Unitea States of AmerIca timely fi led a statement of
opposition. A stipulation was reached between the United States
and Ule appl icant herein and such stipulation is made part of and
incorporated into this proposed ruling, the terms ofwnich are as
follows:

t. Applicant's rights are subject to all senior rights
of the United States of America in the subject source, Includln<j
properly decreed reserved rights, as are now or wIll hereafter De
determined by law.

2. Applicant shall apply for any special use permits or
rtghts-of-way. as the case may oe. if the same are requIred by
law for the use of publ ic resources contemplated Dy the subject
appl ication and shall abide by the conditions set forth therein.
