The.-<;ource of the water is: <br /> <br />East Middle Creek, tributary to Middle Creek, tributary to Saguache Creek, <br />tributary to the Closed Basin. <br /> <br />4. <br />claimed. <br /> <br />Legal description of the stream segment through which an instream flow is <br /> <br />The natural stream channel from the headwaters in the vicinity of"latitude 38019' <br />17"N and longitude 1060 13' 34"W as the upstream terminus and extending to the <br />confluence with Middle Creek at latitude 380 IT 24''N and longitude 1060 18' <br />II "Was the downstream terminus, being a distance of approximately 5.8 miles. <br />This segment can be located on the Bonanza and Chester U.S.G.S. quadrangles <br />and is depicted on Exhibit A. <br /> <br />For the stream segments in an unsurveyed area, the Division Engineer has <br />determined for administrative purposes that the approximate legal description of <br />the instream flow termini as protracted from U.S.G.S. and/or U.S.F.S mapping is <br />as follows: upstream terminus in the SWI/4 SWI/4, Sec. 17, T47N, R7E, <br />N.M.P.M.; downstream terminus in the NEl/4 NE1/4, Sec. 33, T47N, R6E, <br />N.M.P.M. <br /> <br />5. Use of the water: <br /> <br />Instream flow to preserve the natural environment to a reasonable degree. <br /> <br />6. Date of initiation of appropriation: <br /> <br />May 22, 1995. <br /> <br />7. The Colorado Water Conservation Board first applied the water to the above <br />beneficial use on May 22, 1995, under the provisions of ~~ 37-92-102(3), <br />37-92-103(3), (4), and (10), C.R.S. (2000). <br /> <br />8. Amount of water claimed (ABSOLUTE): Instream flow of5.0 c.f.s (April 15 - <br />July 31); 3.0 c.f.s. (August I - October 15); 1.5 c.f.s.
