FINDINGS AND RULING OF THE REFEREE

IN THE MATTER OF THE APPLICATION FOR WATER RIGHTS OF THE
COLORADO W ATER CONSERVATION BOARD ON BEHALF OF THE
PEOPLE OF THE STATE OF COLORADO,

IN EAST MIDDLE CREEK, A NATURAL STREAM,

IN THE WATERSHED OF SAGUACHE CREEK, TRIBUTARY TO THE CLOSED BASIN,

IN SAGUACHE COUNTY, COLORADO.

The Colorado Water Conservation Board filed this application on November 30, 1995.
The application was referred to the Water Referee for Water Division No.3, in accordance with
SS 37-92-101, et seq., C.R.S. (2000). The Colorado Water Conservation Board gave the notices
required by law and the Referee has jurisdiction of this application. There were no Statements of
Opposition filed in this matter and the time for filing such statements has now expired. On April
11,2000, the Division Engineer submitted a Summary of Consultation and the Referee has given
it due consideration.

The Referee having made such investigations as are necessary to determine whether the
statements in the Application are true and being fuIly advised with respect to the subject matter
of the Application.
