The use of the water: <br /> <br />This appropriation is made pursuant to C.R.S. 1973, <br />37-92-l02(3).and 37-92-103(3) and (4). The purpose <br />of this appropriation by the State of Colorado is to <br />insure the preservation of a minimum stream level to <br />protect the nat~ral environment to a reasonable degree. <br /> <br />8. The Applicant, by Stipulation, does not acknowledge at thi~ <br />time any rights to water by the United States of America, <br />but in the future if the United States of America shall seek <br />appropriate judicial determination of any claimed water <br />rights in the watershed involved herein, the Applicant <br />stipulates and agrees that its right shall be subject to any <br />adjudicated senior right of the United States of America. <br /> <br />9. The priority herein awarded said Burning Bear Creek was filed <br />in the Water Court in the year o! 1978 and shall be administer- <br />ed as having been filed in that year; and shall be junior to <br />all priorities filed in previous years.
