Vol.)} do not ap- <br />ply to the Objectors' rights to sell their lands and/or <br />water rights unless the sale involves a change of water <br />rights Application filed with the Water Court. <br /> <br />To resolve the Objectors' concerns with the Application <br />filed in this case, the parties have agreed that in the event the <br />CWCB acquires water rights which are senior in priority to the <br />water rights owned by the Objectors at that time and which are <br />located in the instream flow reached described in the Application <br />filed in this case, the CWCB would be required under the current <br />statutes to file an application to change the use of the acquired <br />water rights with the Water Court. Once a change of use Applica- <br />tion is filed with the Water Court, the current provisions of <br />S37-92-302(1) (b) would allow the Objectors to file statements <br />of Opposition to any proposed change which the Objectors believe <br />may injure their water rights. <br /> <br />The Referee has made such investigations as are necessary <br />to determine whether or not the statements in the Application are <br />true and has become fully advised with respect to the subject <br />matter of the Application. The Referee has spoken to the remain- <br />ing Objector, Ted Myers concerning Mr. Myers' objection to this <br />Application. The Referee has requested that Mr. Myers submit his <br />concerns that members of the pUblic not gain a right to trespass <br />on his property to gain access to the i~stream flow in writing to <br />the Referee. Mr. Myers has failed to comply with the Referee's <br />request. <br /> <br />IT IS HEREBY THE RULING OF THE WATER REFEREE: <br /> <br />1.
