The minimum stream flow right claimed <br />is in the watershed of the Rio Grande, from Its headwaters <br />in vicinity of lat. 37 deg. 31'03" N, long. lOb deg. 52'52" <br />W as the upstream and Big Meadow Reservoir at lat. 37 deg. <br />32'20- N. long. lOb deg. 48'12- W as the downstream terminus, <br />being a distance of approximately 5.1 miles. This segment <br />can be located on the Spar City 15' U.S.G.S. quadrangle. <br /> <br />d. There is no means of diversion, the claim <br />being to a minimum stream flow of 4 cubic feet/second of <br />water per second of time, in place in the stream bed. <br /> <br />e. The date of initiation of suCh appropria~ <br />tion pursuant to the action of applicant under the provision <br />of C.R.S. 1973, 37-92-102(3). and 37-92-103(3), (4) and <br />(10) is July 8. 1980, on which date the water of said stream <br />was first applied to beneficial use to maintain the minimum <br />stream flow required to preserve the natural environment to <br />a reasonable degree. <br /> <br />f. That applicant is entitled to an absolute <br />in place minimum stream flow water right for such beneficial <br />use with a priority date of July 8, 1980. <br /> <br />THEREFORE. IT IS RULED AND ORDERED that the application <br />herein be and it is hereby granted, and that applicant is <br />awarded an absolute in place minimum stream flow water right <br />for 4 cubic feet/foot of water per second of time in South <br />Fork Rio Grande, with a priority date of July 8. 1980 for <br />the purpose of maintaining the minimum stream flow as required <br />to preserve the natural environment to a reasonable degree. <br />unconditionally, subject, however, to all priority rights <br />of senior appropriators of water in the affected watershed. <br /> <br />-2- <br />
