RULING OF Rf:FEREE

Pursuant to Order of Referral filed and entered in

the above case on December 29, 1977, the undersigned Water

Referee, having investigated the matter of the Application

on file herein, hereby makes the following findings and

ruling thereon:

FnDINGS OF FACT

1. That the said Application was filed on December 29,

1977.

2. That the Water Clerk caused publication of such filing
as provided by statute; that the time for filing Statements of
Opposition expired on the last d~y of February, 1978, and that
such a statement was filed by the Southeastern Colorado Water
Conservancy District.
3. That on March 17, 1978, the undersigned Water Referee
re-referred the case to the 11ater Judge pursuant to the authority
granted the said Referee in C.R.S. 1973, 37-92-303(2).
4. That on December 20, 1979, the said District withdrew
its objection, and on December 28, 1979, the Water Judge re-
manded the case to the undersigned Water Referee for investigation
a~d ruling thereon.
