Location: <br /> <br />Legal description of the stream segment through which an <br />instream flow is claimed: The natural stream channel from <br />headwaters in the vicinity of lat. 39 deg. 36'10"N, long. <br />106 deg. 10'18"W as the upstream terminus and extending to <br />a point coincident with the eastbound 1-70 bridge in NE/4 <br />SE/4 Sec. 27 T5S R78W 6th P.M. as the downstream terminus, <br />being a distance of approximately 4.1 miles. This segment <br />can be located on the Vail Pass, Frisco O.S.G.S. <br />quadrangle(s). <br /> <br />For administrative purpoSes only, the Division Engineer for <br />Water Division 5 has translated the segment thus described <br />into approximate protracted section, township, and range <br />locations from O.S.G.S. mapping as follows: Upstream <br />terminus in the NW/4 SW/4 S19 T5S R78W 6th P.M., more spe- <br />cifically at a point whence the NW corner of S18 T5S R78W <br />bears S05 30E a distance of 7,950 ft. <br /> <br />c. (1) Date of initiation of appropriation: November 8, <br />1985. <br /> <br />'(2) Date water applied to beneficial use: Water was first <br />applied to beneficial use on November 8, 1985, pursuant to <br />S 37-92-103(4), C.R.S. (1973). <br /> <br />(3) How appropriation was initiated: By applicant's <br />approval of its staff's final recommendations at a regu- <br />larly scheduled meeting, subsequent to having requested and <br />considered recommendations from the Division of Wildlife, <br />and the Division of Parks and Outdoor Recreation. <br /> <br />d.
