b. Location:

Legal description of the stream segment through which an
instream flow is claimed: The natural stream channel from
headwaters in the vicinity of lat. 39 deg. 36'10"N, long.
106 deg. 10'18"W as the upstream terminus and extending to
a point coincident with the eastbound 1-70 bridge in NE/4
SE/4 Sec. 27 T5S R78W 6th P.M. as the downstream terminus,
being a distance of approximately 4.1 miles. This segment
can be located on the Vail Pass, Frisco O.S.G.S.
quadrangle(s).

For administrative purpoSes only, the Division Engineer for
Water Division 5 has translated the segment thus described
into approximate protracted section, township, and range
locations from O.S.G.S. mapping as follows: Upstream
terminus in the NW/4 SW/4 S19 T5S R78W 6th P.M., more spe-
cifically at a point whence the NW corner of S18 T5S R78W
bears S05 30E a distance of 7,950 ft.

c. (1) Date of initiation of appropriation: November 8,
1985.

'(2) Date water applied to beneficial use: Water was first
applied to beneficial use on November 8, 1985, pursuant to
S 37-92-103(4), C.R.S. (1973).

(3) How appropriation was initiated: By applicant's
approval of its staff's final recommendations at a regu-
larly scheduled meeting, subsequent to having requested and
considered recommendations from the Division of Wildlife,
and the Division of Parks and Outdoor Recreation.
