7. The use of the water:

This app~opriation is made pursuant to C.R.S. 1973,
37-92-102(3) and 37-92-103(3) and (4). The purpose
of this ~ppropriation by the State of Colorado is to
insure the preservation of a minirnQrn stream level to
protect the natural environment to a reasonable degree.

8. The Applicant, by Stipulation, does not acknowledge at this
time any rights to ~ater by the United States of America, but in the
future if the united States of America shall Seek appropriate jUdicial
determination of any claimed water rights in the watershed involved
herein, the Applicant stipulates and agrees that its right shall be
subject to any adjudicated senior right of the united States of America.

9. The prio~ity herein awarded said Seven Mile Creek was filed
in the Water Court in the year of 1978 and shqll be administered as
having been filed in that yeari and shall be junior to all priorities
filed in previous years. As between all rights, filed in the same
calendar year, prio~ities shall be determined by historical dates of
appropriation and not affected by the date of entry of ruling.
