4. The applicant has, in the past, and intends in

the future, to support the construction of the West Divide

Project either in the form as decreed by the Court for the

structures above described, or in such revised form as

ultimately may be selected by the Board of Directors of the

West Divide Water Conservancy District. In furtherance of

said support, the applicant hereby agrees that it will not

oppose any efforts by the West Divide Water Conservancy

District to change its decrees in any fashion, so to conform

the decrees to the project as built, and specifically, will

not claim in opposition to such a change action, any injury

to any water right which may be herein decreed.

5. In consideration of said stipulation, the Board

of Directors of the West Divide Water Conservancy District
