CREEK IN EAGLE" COUNTY

The applicant, Colorado Water Conservation Board,

by its attorney J. D. McFarland, Attorney General of the

State of Colorado, and the objector, West Divide Water Con-

servancy District, by its attorneys Delaney and Balcomb,

hereby stipulate and agree as follows:

1. The claims in the above captioned matter, are

made pursuant to C.R.S. 1973, 37-92-102(3) and 37-92-103(3)

and are for such "minimum stream flows" as they be necessary

to preserve the natural environment to a "reasonable degree".

2. The West Divide Water Conservancy District, one

of the objectors herein, is the local entity responsible for

the operation of and repayment of construction costs of the

West Divide Project, as authorized by the United states

Congress in P.L. 90-537, 74 USC S620, as amended.

3. In connection with the West Divide Project, the

Colorado River Water Conservation District is the owner of

certain decrees for features described as follows:
