<br />5. That the claims contained in the said. Application
<br />are made under the provisions of C.R.S. 1973, 37-92-102 (3)
<br />and 37-92-103 (3), (4) and (10).
<br />
<br />6. That an informal hearing was held by the under-
<br />
<br />
<br />signed Water Referee on April 6, 1977, at 308 Judicial
<br />
<br />Building, Pueblo, Colorado, and that those present were
<br />
<br />as follows: David W. RObbins, First Assistant Attorney
<br />
<br />General, for the Applicant; Duane D. Helton, P.E., Engineer
<br />
<br />for Applicant; Mr. and Mrs. Frank K. Yones (a/k/a) Yanis,
<br />Objectors; Mervin A. Ziegler, Attorney for an Objector;
<br />Hazel C. Noe, Legal Assistant to Mr. Ziegler; and Robert
<br />
<br />w. 'Jesse, Division Engineer.
<br />
<br />7. That witnesses were placed under oath and testimony
<br />
<br />heard.
<br />
<br />8. That Objectors present indicated' that their interest
<br />
<br />lay in protecting certain direct flow priorities located in
<br />
<br />the claim area.
<br />
<br />9. That at the conclusion of the said hearing all par-
<br />
<br />
<br />ties indicated that a stipulation could be arranged in the
<br />
<br />matter.
<br />
<br />10. That on February 27, 1978, such a stipulation waS
<br />filed, as follows:
<br />
<br />a. The applicant herein, Colorado Water Conservation
<br />Board, is authorized by C.R.S. 1973, 37-92-102 (3),
<br />37-92-103(3) (4) and (10) to file for such minimum
<br />flows into natural streams of the State as are
<br />necessary to preserve the natural environment to
<br />a reasonable degree, and said applicant did, in
<br />fact, file an application for a water right grant-
<br />ing a minimum flow in Big Union Creek on May 17, 1976.
<br />
<br />b. That subject to the conditions hereinafter set faith,
<br />the applicant is entitled to a decree bearing a
<br />priority date of January 14, 1976, in the, amount
<br />of 8 c.f.s., for the purpose of maintaining flow
<br />in Big Union Creek from its headwaters to its con-
<br />fluence with the Arkansas River in Lake County.
