<br />Pursuant to Order of Referral filed and entered in
<br />the above case on May 17, 1976, the undersigned Water Referee,
<br />having investigated the matter of the Application on file
<br />herein, hereby makes the following findings and ruling thereon:
<br />
<br />FINDINGS OF FACT
<br />
<br />1. That the said Application was filed on May 17, 1976.
<br />
<br />2. That the Water Clerk caused publication of such filing
<br />as provided by statute; that the time for filing Statements of
<br />Opposition expired on the last day of July, 1976, and that one
<br />such statement was filed on 'July 30, 1976, by Mervin A. Ziegler,
<br />
<br />Attorney at Law, on behalf of Mount Massive Lakes, Inc., a
<br />
<br />fishing club located in Lake County, Colorado.
<br />
<br />3. That a second such statement was filed on August 10,
<br />
<br />1976, by Prank R. Yones (a/k/a) Yanis, of LeadVille, Colorado.
<br />
<br />4. That the said Application concerns Big Union Creek, a
<br />stream located in Lake County, Colorado, and to be used for the
<br />
<br />maintenance of such minimum flows as are required to preserve
<br />.
<br />
<br />the natural environment to a reasonable degree.
