<br />".,\' <br /> <br />2. That it is further agreed and stipulated between the <br /> <br /> <br />parties: <br /> <br /> <br />a. That based on studies conducted by the Colorado <br /> <br /> <br />Division of Wildlife, 10 c.f.s. is recognized as <br /> <br /> <br />the "survival flow" of Cottonwood Creek referenced <br /> <br />in the abovementioned decree; <br />b. That such exchanges shall not cause the flow of <br />Cottonwood Creek to be depleted below the "survival <br />flow" of 10 c.f.s.; <br />c. That such exchanges continue no longer than two <br />weeks in duration providing such exchange causes <br />the flow of Cottonwood Creek to be depleted below <br />the decreed flow of 20 c.f.s.; <br />d. That, providing such exchanges cause the flow of <br />Cottonwood Creek to be depleted below the decreed <br />flow, a minimum of one week shall be allowed between <br /> <br />such exchanges aI,lowing time for the stream to "resttt; <br />e. That the sequence of provisions c. and d. may be re- <br />peated as often as necessary for the execution of such <br />exchanges; <br />f. That this agreement and stipulation is based on mutual <br />recognition of the long-standing intention of the South- <br />eastern Colorado Water Conservancy District to make such <br />exchanges to benefit its constituents; <br />g. That fish can, exist with a "survival flow" only for a <br />short time; and <br />h.
