Legal description of the stream segment: The natural stream <br />channel from headwaters in the NE/4 NW/4 Sll T9N R74W 6th P.M. as <br />the upstream terminus and extending to the confluence with North <br />Fork Lone Pine Creek in the NE/4 SE/4 S34 TlON R72W 6th P.M. as <br />the downstream terminus, being a distance of approximately 13.9 <br />miles. This segment can be located on the South Bald Mountain, <br />Red Feather Lakes and Haystack Gulch U.S.G.S. quadrangles. <br /> <br />3. The source of water: South Fork of Lone Pine Creek, a tribu- <br />tary of Lone Pine Creek, a tributary of the Cache la Poudre <br />River. <br /> <br />4. Date of initiation of appropriation: November 8, 1985. <br /> <br />5. Amount of water claimed: Instream flow of 2.0 c.f.s. abso- <br />lute. <br /> <br />6. The use of the water: To maintain such minimum stream flows <br />as are required to preserve the natural environment to a reason- <br />able degree pursuant to ~ 37-92-102 and 103 C.R.S. (1973 and 1988 <br />Supp.). No diversions of the water right herein will be made <br />from the natural stream channel. <br /> <br />7. The applicant shall install and maintain such measuring <br />devices and maintain such records as the Division Engineer may <br />require for administration of this right. <br /> <br />8. The priority herein awarded, said South Fork of Lone Pine <br />Creek instream flow was filed in the water court in 1985 and <br />shall be administered as having been filed in that year; and <br />shall be junior to all priorities filed in previous years. As <br />between all rights filed in the year of 1985, priorities shall be <br />determined by historical dates of appropriation and not affected <br />by the date of entry of ruling. <br /> <br />Dated this 13th <br /> <br />day of <br /> <br />April <br /> <br />, 1989. <br /> <br />-2- <br />
