<br />2. Pursuant ta sectian 37-92-102(3)(b), C.R.S. (2000), the CWCB acknawledges and agrees that
<br />the instream flaw water right applied far herein is subject ta the use described abave.
<br />'Cansequently, the CWCB will nat place a call far the instream flaw water right decreed
<br />herein as against the Objectars' exercise .of the abave-described water rights far said uses and
<br />in said amaunts.

<br />structure, diverting fram Dallas Creek (listed belaw), which water rights the parties hereta
<br />recognize and agree are seniar far their decreed purpases, including starage in the Fairway
<br />Pines Galf Caurse Pands, to the CWCB' s instream flaw right applied far herein:

<br />alternate paint .of diversian thraugh the Laghill Pumping Plant and a change .of use fram
<br />irrigatian .only ta irrigatian and municipal, including: industrial, residential, cammercial,
<br />recreatian, fish culture, and storage purpases, pursuant ta the decree entered in Case Na.
<br />W-1358 an May 23,1974, with an appropriatian date afJune 1,1879. '

<br />b. Hyde-Sneva Ditch, Priarity Na. 42, in the amaunt .of 0.125 C,LS., changed ta an alternate
<br />paint .of diversian thraugh the Laghill Pumping Plant and a change afuse fram irrigation
<br />.only ta irrigation and municipal, including: industrial, residential, cammercial, recreation,
<br />fish culture, and starage, pursuant ta the decree entered in Case Na. W-1357 an May 23,
<br />1974, with an apprapriatian date afOctaber 10,1880.

<br />c. Hyde-Sneva Ditch, Priarity Na, 100, in the amaunt .of 0,625 C.LS., changed ta an alternate
<br />paint .of diversian thraugh the Laghill Pumping Plant and a change afuse fram irrigatian
<br />.only ta irrigatian and municipal, including: industrial, residential, cammercial, recreatian,
<br />fish culture, and starage pursuant ta the decree entered in Case,Na, W-1357 an May 23,
<br />1974, with an appropriatioil date of May 1, 1886,

<br />4. The Laghill Pumping Plant, decreed far municipal purpases, including, industrial, residential,
<br />cammercial, recreatianal and fish culture purpases in the amaunt .of 0.66 C.LS., absalute, and
<br />1.21 c.f.s., canditional, in Case Na, 93CW66 (.original decree Case Na, W-136S) with an
<br />apprapriatian date .of March 17, 1971.

<br />3. The CWCB agrees ta nat appase .or pratest a Ruling .of Referee .or Decree prapased .or issued
<br />in Case Na. 99CW222, currently pending in the Divisian 4 Water Caurt, that is cansistent
<br />with the tenns and canditians of this Stipulatian,
<br />
<br />5. Dallas Creek Water Camp any agrees ta the entry .of a decree na less restrictive than the .one
<br />attached hereta and marked as Attachment B.
<br />
<br />6. This stipulation shall be binding upan the parties hereta, their successors, and assigns.
<br />
<br />,7. Dallas Creek Water Campany shall remain an the mailing list in this case and shall be
<br />provided with a capy of any prapased referee's ruling and/ar decree in this matter.
