STIPULATION

The Applicant, Colorado Water Conservation Board ("CWCB"), and Objector Dallas
Creek Water Company, by and through their respective undersigned attomeys, hereby stipulate
and agree as follows:

1. Based upon the affidavit of James A. Willey (attached as Exhibit A and incorporated herein),
the Application For Storage Water Rights of Fairway Pines Golf Partners, Ltd. in Case No.
99CW222, and discussions with Water Commissioner Eric Weig, the CWCB agrees that the
Fairway Pines Golf Partners, Ltd.'s and the Dallas Creek Water Company's diversion of
water from Dallas Creek for the first fill of and storage in (1) Fairway Pines Golf Course
Pond No.2 in the amount of 5.05 acre-feet, (2) Fairway Pines Golf Course Pond No.3 in the
amount of3.5 acre-feet, and (3) Fairway Pines Golf Course Pond No, 4 in the amount of5,8
acre-feet, and use of said stored water for irrigation of the Fairway Pines Estates Golf
Course, all of which were uses of water in existence on the date the CWCB appropriated the
instream flow water right applied for herein.
