The name and address of the Applicant is: <br /> <br />Colorado Water Conservation Board <br />1313 Sherman Street, Suite 721 <br />Denver, Colorado 80203 <br />(303) 866-3441 <br /> <br />2. The name of the natural stream is Dallas Creek (instream flow). <br /> <br />3. The source of the water is Dallas Creek, tributary to the Uncompahgre River. <br /> <br />4. Legal description of the stream segment through which an instream flow is <br />claimed: <br /> <br />The natural stream channel from the East & West Dallas Creeks in the SW1/4 <br />NW1/4, S24, T45N, R9W, NMPM as the upstream terminus and extending to <br />Ridgway Reservoir in the SW1/4 SE1/4, S33, T46N, R8W NMPM as the <br />downstream terminus, being a distance of approximately 5.8 miles. This segment <br />can be located on the Ridgway and Dallas U.S.G.S. quadrangles. See Exhibit A. <br /> <br />5. Use of water: Instream flow to preserve the natural environment to a reasonable <br />degree. <br /> <br />6. Date of initiation of appropriation: July 13, 1998. <br /> <br />7. The water was first applied to the above beneficial use on July 13, 1998, by action <br />of the Colorado Water ConservationBoard under the provision ofC.RS. ~ ~ 37- <br />92-102(3),37-92-103(3), (4), (10). <br /> <br />8. Amount of water claimed (ABSOLUTE): Instream flow of 20.0 c.f.s. (May 1 _ <br />October 14); 9,0 c.f.s. (October 15 - April 30). <br /> <br />9. Proposed Terms and Conditions: <br /> <br />Pursuant to section 37-92-102(3)(b) and to the Applicant's stipulations with <br />Objectors Fairway Pines Golf Partners, Ltd. and the Dallas Creek Water <br />Company, the instream flow water right decreed herein shall be subject to those <br />Objectors' diversion of water from Dallas Creek for the first fill of arid storage in <br />(1) Fairway Pines Golf Course Pond No.2 in the amount of5,05 acre-feet, (2) <br />Fairway Pines Golf Course Pond No.3 in the amount of 3.5 acre-feet, and (3) <br />Fairway Pines Golf Course Pond No.4 in the amount of5.8 acre-feet, and use of <br />said stored water for irrigation of the Fairway Pines Estates Golf Course, all of <br /> <br />2 <br />
