This Application was filed on February 25,1999, and was referred to the Water Referee
for Water Division No.4, in accordance with C.R.S, S S 37-92-101, et seq, All notices required
by law of the filing of this Application have been fulillled and the Referee has jurisdiction of this
Application. Statements of Opposition were filed by Dallas Creek Water Company, Wolf Land
Company and James A Willey in this matter. On September 2, 1999, the Division Engineer
submitted a Summary of Consultation and the Referee has given it due consideration. The
Applicant and Objector Wolf Land Company entered into a stipulation on May 9, 2000, On.
April 11, 2001, Objector James A Willey filed a Substitution of Party to substitute Fairway
Pines Golf Partners, Ltd. as an Objector, which substitution the Referee approved on April 17,
2001, The Applicant entered into Stipulations with Objectors Dallas Creek Water Company and
Fairway Pines Golf Partners, Ltd, on September 25, 2002.

Having made such investigations as are necessary to determine whether the statements in
the Application are true and being fully advised with respect to the subject matter of the
Application;
