<br />. <br /> <br />. <br /> <br />8.0 c.f.s. (May I - September 30); 3.0 c.f.s. <br />(October I - April 30), all absolute. <br /> <br />9, The use of the water is: <br /> <br />For instream flows to preserve the natural environ- <br />ment to a reasonable degree. <br /> <br />The Referee finds that this application should be granted, <br />and an absolute decree for 8.0 c.f.s, (May I - September 30), 3.0 <br />c.f.s, (October I - April 30) is hereby awarded for the purpose <br />of maintaining an instream flow to preserve the natural environ- <br />ment to a reasonable degree in Road Beaver Creek between the <br />upstream and downstream points as described in paragraph 4 above, <br />with an appropriation date of November 9, 1992. The priority <br />herein awarded was filed in the water court in the year of 1992 <br />.and shall be administered as having been filed in that year, and <br />shall be junior to all priorities filed in previous years. As <br />between all rights filed in the same calendar year, priorities <br />shall be determined by historic date of appropriation and not be <br />affected by the date of entry of ruling. The Applicant shall <br />install and maintain such measuring devices and maintain such re- <br />cords as the Division Engineer may require for administration of <br />this right. <br /> <br />It is accordingly ORDERED that this Ruling shall be filed <br />with the Water Clerk subject to Judicial review. <br /> <br />It is further ORDERED that a copy of this Ruling shall be <br />filed with the Division 4 Engineer and the State Engineer. <br /> <br />DATED this /7~ay of ~~ , 1994. <br /> <br />BY THE REFEREE: <br /> <br />.A,~ ?'[.l'f <br /> <br />Water Referee <br />Water Division No. 4 <br />State of Colorado <br /> <br />No protest was filed in this matter.
